GENERAL TERMS OF SALE

1. GENERAL PROVISIONS, DEFINITIONS

    DEKOD d.o.o., headquartered in Zagreb, Savska cesta 28, VAT number: 49600228271 (hereinafter referred to as "DEKOD"), is a company that provides services of selling and distributing Tickets for Events by various Organizers. For the purpose of providing such services, DEKOD is the owner and operator of the website www.ulaznice.hr (hereinafter referred to as the "Portal").

    Please carefully read these General Terms of Sale (hereinafter referred to as the "Terms") before purchasing a Ticket through the Portal. By purchasing a Ticket through the Portal, you declare that you agree to be bound by these Terms. DEKOD is authorized to modify the Terms at any time and without prior notice.

    For the purpose of interpreting these Terms, the following terms have the following meanings:

  • „Dekod“ is a commercial company specialized in all actions and transactions related to the production, sale, and distribution of Tickets;
  • „Event“ means a concert, music-theatrical, cultural-artistic, sports, or other event for which it is possible to purchase Tickets through the Portal;
  • „Customer“ " means a person who has made a purchase of a Ticket through the Portal;
  • „Organizer“ is an independent legal entity responsible for organizing a specific Event, on behalf of whom DEKOD sells Tickets through the Portal;
  • „Portal“ means the ticket sales system via www.ulaznice.hr website;
  • „Event terms and conditions of sale“ means the terms and conditions of sale and use of Tickets for a specific Event, such as price, discounts, sales campaign period, etc., determined by the Organizer;
  • „Transaction fee“ i/ili „Ticket price fee“ means the amount that the Customer is obliged to pay to DEKOD when purchasing Tickets via the Portal, as a fee for the services provided by DEKOD to the Customer in relation to the purchase of Tickets.

2. TICKET SALES

    DEKOD is an independent company that sells Tickets on behalf of and for the account of the Organizer of a specific Event. Accordingly, DEKOD is not the Organizer, nor is it in any way responsible for the actual organization of the Event.

    The list of Events for which Tickets can be purchased through the Portal is available on the Portal. The purchase of Tickets for a specific Event is subject to the Event terms and conditions of sale, such as the maximum number of Tickets available for purchase for an Event. The Event terms and conditions of sale are determined by the Organizer and are available on the Portal. The Event terms and conditions are subject to change at any time.

    Please note that the use of Tickets for specific Events may be subject to general or other conditions determined by the Organizer. Therefore, we recommend that you familiarize yourself with any such conditions before purchasing Tickets by accessing the website of the Event Organizer or by contacting the Organizer directly.

    In order to purchase a Ticket, the Customer is obliged to enter their personal information, including their email address in the corresponding fields on the Portal. The Customer is responsible for the accuracy and validity of the entered information and assumes the risk of being unable to use the Ticket if the entered information is inaccurate or invalid.

    By purchasing a Ticket through the Portal, the Customer obtains the right to access the Event for which the Ticket was purchased. DEKOD bears no responsibility for the Event or the circumstances of its organization; the exclusive responsibility lies with the Organizer of the respective Event. Therefore, any complaints regarding the Event must be submitted to the Organizer of that Event.

    The Event terms and conditions of sale constitute an offer to conclude a contract, which the Customer accepts by purchasing a Ticket for such Event through the Portal. By purchasing a Ticket for a specific Event, the Customer enters into a contract with the Event Organizer. At the same time, by purchasing the Ticket, the Customer enters into a contract with Dekod as the provider of the Portal service for the purpose of processing, generating, and issuing the Ticket for the Event.

3. PAYMENT TERMS

    Payment for Tickets can be made through the payment methods listed on the Portal. Dekod is authorized to change the available payment methods at any time without notice.

    By purchasing the Ticket, you authorize Dekod to charge the total amount, which includes the Ticket price and any other fees and/or costs, using the selected payment method. The Customer is responsible for any bank or other fees incurred by using the selected payment method.

    If the Customer is using a bank transfer payment to Dekod's account, all Tickets for which the payment is not received within a maximum of 72 working hours from the time of purchase will be canceled.

4. TRANSACTION FEE AND TICKET PRICE FEE

    For the service of generating and issuing Tickets for specific Events, Dekod may charge the Customer a transaction fee and/or a ticket price fee.

    The transaction fee and ticket price fee represent compensation for costs incurred to Dekod in providing services, including Ticket sales and issuing, transaction and Ticket purchase processing, and others. Dekod will issue an appropriate invoice for the charged transaction fee and/or ticket price fee, which will be sent to the Customer via email to the email address provided by the Customer during the Ticket purchase process.

5. TICKET AND INVOICE DELIVERY

    After a successful purchase, the Tickets and corresponding invoices will be delivered to the Customer via the Portal (Purchase Overview) and to the email address provided by the Customer during the purchase.

    Depending on the terms of the specific Event and the options chosen by the Customer during the purchase process, Tickets may also be delivered to the Customer in another way. In such a case, the Customer is obligated to bear the costs of ticket delivery using the chosen delivery method.

6. USING THE TICKETS

    The purchased Ticket entitles the Customer to attend the Event. The Customer is obliged to keep the Tickets and not provide them to third parties.

    The Customer bears exclusive responsibility for stolen, lost, altered, destroyed, or copied Tickets. The Customer acknowledges that the right to use certain Tickets, such as Tickets containing a unique code imprinted directly on the Ticket itself, is granted to the person who first requests access to the Event. Therefore, the Customer agrees not to hold Dekod and/or the Event Organizer responsible if they were unable to use the Ticket on the basis mentioned above.

    Upon entry to the Event, the Organizer has the right to verify the validity of the Tickets and the identity of the person presenting the Ticket.

    Reproduction, resale, or further trading of Tickets purchased through the Portal is strictly prohibited. Any attempt to use Tickets that is not in accordance with these General Terms or the terms set by the Event Organizer may result in the loss of the right to use the Ticket.

7. EVENT TERMS CHANGES, CANCELLATION

    The sales and other terms of a specific Event are determined by the Organizer of that Event. The Organizer is authorized to change the terms of the Event at any time, so Customers are advised to regularly inform themselves about the sales and other terms of the Event for which they have purchased Tickets.

    Dekod is not obligated to inform Ticket Customers about any cancellations, postponements, or other changes to the Event terms.

8. TICKET REFUND

    In accordance with Article 79, Paragraph 1, Point 12 of the Consumer Protection Act, the Customer does not have the right to unilaterally terminate the contract as the subject of the contract involves the provision of leisure-related services that take place at a specific time or within a specified period.

    The Customer can exercise the right to a ticket refund only if the event has been cancelled. Refunds are not possible in the case of personal reasons on the Customer's side (illness, work obligations, change of mind, and others). The refund of the ticket price is generally processed through the same payment method used for the purchase.

    When refunding the ticket price, Dekod and/or the Event Organizer have the right to withhold any amount based on incidental costs, such as ticket delivery expenses, banking and transaction fees, and other similar costs. The Customer does not have the right to claim compensation for damages and waives the right to seek any compensation from Dekod.

    In the event of event cancellation, Dekod will process the refund if this is possible according to the terms of the contract between Dekod and the respective Organizer. If Dekod is unable to process the refund, the Customer will be notified and advised to request the refund from the Organizer.

    The transaction fee is non-refundable, and the Customer does not have the right to a refund of the fee even in the event of event cancellation. As Dekod has fully performed its service of selling and issuing the ticket, Dekod cannot be held responsible in case of event cancellation. The Customer confirms being aware of the above before purchasing the ticket and expressly declares that they agree not to seek a refund of the transaction fee or any other compensation or cost upon the successful completion of the ticket purchase process.

9. PERSONAL DATA PROCESSING

    For the purpose of fulfilling contractual obligations, Dekod collects and processes certain personal data. Dekod processes personal data on its own behalf and for its own account, regarding the data necessary for the provision of services that Dekod has undertaken to provide to the Customer, or on behalf and for the account of the Organizer of the specific event, regarding the data necessary for the purchase and use of the ticket and access rights to the event.

    By using the Portal and purchasing the ticket, the Customer gives consent to Dekod for the personal data processing for the purpose of fulfilling contractual services.

    Dekod undertakes to carefully process and protect personal data in accordance with the obligations prescribed by the Personal Data Protection Act.

    Personal data is generally stored and processed in electronic form. After the need for maintaining the personal data database ends or upon the request of the Customer, the data is deleted. At the time of collecting personal data, each Customer has the right to review, transcribe, copy, add, correct, block, and delete personal data from the personal data database.

10. COMPLAINT SUBMISSION

    In accordance with the provisions of the Consumer Protection Act, a written complaint can be sent by email to: operacije@dekod.hr, by mail to the address: Dekod d.o.o., Savska cesta 28, 10000 Zagreb, or personally at the business premises of Dekod located at the same address.

    Upon receiving a written complaint, Dekod will confirm receipt of the complaint in writing, in the manner determined in the preceding paragraph, and respond to the complaint within 15 days from the day of receiving the complaint.

11. APPLICABLE LAW, DISPUTES

    The laws of the Republic of Croatia apply to all contractual relationships between Dekod and Customers concluded through the use of the Portal and Ticket purchase.

    In the event of any disputes, the court with jurisdiction will be determined according to the seat of Dekod.

12. GENERAL TERMS OF USE FOR ULAZNICE.HR GIFT CARDS

12.1. General Provisions

    12.1.1. The general terms of use for Ulaznice.hr gift vouchers determine the rights and obligations regarding the use of Ulaznice.hr gift vouchers. These conditions are binding for both the issuer and the user of Ulaznice.hr gift vouchers.

    12.1.2. By purchasing Ulaznice.hr gift vouchers, the user is considered to agree and accept the terms of sale. The issuer reserves the right to modify and/or supplement these terms of sale at any time. Any such changes come into effect on the day of publication.

    12.1.3. Continuing to use Ulaznice.hr gift cards after changes in the terms of sale will be considered as the buyer's acceptance of such modified or supplemented terms of sale.

    12.1.4. The issuer of Ulaznice.hr gift cards is Dekod d.o.o., Savska cesta 28, 10000 Zagreb, OIB: 49600228271. The gift card user can be any individual or legal entity using the Ulaznice.hr gift card by presenting it as a means of payment when purchasing tickets on the Ulaznice.hr web portal only, in an amount specified on the Ulaznice.hr gift card.

12.2. Using Ulaznice.hr Gift Cards

    12.2.1. Ulaznice.hr Gift card is a payment method issued with a unique number (code).

    12.2.2. The gift card is issued upon receiving payment, the amount of which is determined by the user, and in accordance with the terms of sale, the issuer is obliged to accept it as a means of payment when purchasing tickets available via Ulaznice.hr web portal, operated by the issuer in the Republic of Croatia.

    12.2.3. Ulaznice.hr gift cards can be purchased by both individuals and legal entities.

    12.2.4. A maximum of 9 tickets can be purchased with one gift card in a single transaction.

    12.2.5. Ulaznice.hr gift cards can be used for all organizers and events published on the Ulaznice.hr web portal by simply entering the code printed on the Ulaznice.hr gift card.

    12.2.6. When creating the desired transaction, the transaction amount is reduced by the value of the Ulaznice.hr gift card.

    12.2.7. Ulaznice.hr gift vouchers are available in the amount of 10.00 €, 15.00 €, 20.00 €, 30.00 €, 50.00 €, and 100.00 €.

12.3. Validity period and use of Ulaznice.hr gift cards

    12.3.1. The validity period of Ulaznice.hr gift card is one year from the date of purchase.

    12.3.2. Ulaznice.hr gift vouchers can be used multiple times up to the limit obtained by the purchase of the Ulaznice.hr gift card. If the limit on the Ulaznice.hr gift card is lower than the total transaction amount, the difference must be paid using another payment method. If the limit on the Ulaznice.hr gift card is higher than the total transaction amount, the Ulaznice.hr gift card is debited by the amount to be spent, and the difference can be spent until the expiration date of the gift card

    12.3.3. Ulaznice.hr gift card purchased on the Ulaznice.hr web portal can only be used on the Ulaznice.hr web portal.

12.4. Event cancellation

    12.4.1. In the event of event cancellation, for tickets purchased using Ulaznice.hr gift cards, the customer will receive a refund on the same gift card in the same amount, valid for one year from the date of refund.

12.5. Ulaznice.hr Gift Card Cancellation

    12.5.1. Refunds can be obtained at any time before the expiration date of the gift card.

    12.5.2. The right to a refund, as well as obtaining additional information about the use of Ulaznice.hr gift cards, can be obtained by contacting: helpdesk@ulaznice.hr or podrska@ulaznice.hr.

    12.5.3. Ulaznice.hr gift cards cannot be exchanged for cash.

12.6. Loss of the Ulaznice.hr Gift Card

    12.6.1. In case of loss, theft, destruction, or expiration of the validity period of Ulaznice.hr gift card, the customer cannot request a refund or any other compensation.
